Terms & Conditions
These Forward Rewards terms and conditions form the agreement (“The Agreement”) between you (“You”) and Forward Corporation and its affiliates and subsidiaries (“Company”).
Agreement to Terms. By applying for and using the Forward Rewards Tag, the participant agrees to be bound by the current Forward Rewards Terms & Conditions, a copy of which can be obtained at any participating Company location. Forward Rewards participants must complete and submit the Forward Rewards Participant Application in order to receive and use the Forward Rewards Tag.
Operational Terms. Points may be earned at participating Company locations for qualifying purchases (as specified by Company) using approved payment means. Points will not be accumulated for the following purchases: Lottery Tickets, Cigarettes, Money Orders, Bottle Deposits, Gift Cards, Licenses & Permits, Video Rentals, Laundry & Pay Phones, Car Washes purchased at the wash entrance point of sale, Store Services, or Third Party Services.
Participants must present a valid Forward Rewards Tag to earn points. The tag must be presented at the time of purchase. Points will not be awarded without a valid Forward Rewards Tag or for previous purchases. Only one Forward Rewards Tag per customer. Points may not be combined or transferred between participants.
Forward Rewards coupons may be redeemed at any participating Company location, unless otherwise specified, so long as the reward item is available at the location. To be accepted by any participating Company location, reward coupons must not be expired, illegible, altered or damaged. Duplicates of original reward coupons will not be accepted. Validation of participant details may be required in order to redeem reward. Lost, stolen, or damaged reward coupons will not be replaced.
Company may substitute any reward or prize for those of a comparable value without notice. |
Company is not responsible for lost, stolen or damaged tags or unredeemed points, however these may be replaced at Company’s discretion. Company is not responsible for any errors or lost rewards resulting from computer hardware or software errors or fraud. In the event of a dispute regarding any part of the program including participation, Company's decision will be final and binding on You and the program.
All Forward Rewards Tags are licensed to Company and tag ownership does not transfer to the
participant. Company may cancel any Forward Rewards Tag at any time at its sole discretion. Company may amend the Forward Rewards Participant Terms and Conditions or any specific Forward Rewards promotion at any time. It is the participant’s obligation to keep informed of the latest Forward Rewards Terms and Conditions. Company reserves the right to terminate the Forward Rewards program at any, or all, participating locations at any time without prior notice.
NO WARRANTY. THE FORWARD REWARDS PROGRAM, INCLUDING ALL CONTENT, SOFTWARE, FUNCTIONS, MATERIAL AND INFORMATION MADE AVAILABLE TO YOU OR ACCESSED BY YOU, IS PROVIDED “AS IS”. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, COMPANY MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER FOR THE CONTENT OF THE FORWARD REWARDS PROGRAM OR THE MATERIALS INFORMATION AND FUNCTIONS MADE ACCESSIBLE. FURTHER, COMPANY DISCLAIMS ANY EXPENSE OR IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. COMPANY ASSUMES NO RESPONSIBILITY, AND SHALL NOT BE LIABLE FOR ANY DAMAGES BY USE OF THE FORWARD REWARDS PROGRAM. COMPANY AND ITS SUBSIDIARIES AND AFFILIATES SHALL NOT BE LIABLE FOR THE USE OF THE FORWARD REWARDS PROGRAM, INCLUDING, WITHOUT LIMITATION, THE CONTENT AND ANY ERRORS CONTAINED THEREIN. COMPANY SHALL NOT BE LIABLE FOR ANY FAILURE OF THE FORWARD REWARDS PROGRAM WHICH RESULTS FROM ACTS OR EVENTS BEYOND THE COMPANY’S REASONABLE CONTROL. NO AWARD OF DAMAGES AGAINST COMPANY. |
IN NO EVENT SHALL COMPANY BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL OR OTHER DAMAGES ARISING OUT OF THE USE OF THE FORWARD REWARDS PROGRAM. THIS INCLUDES, WITHOUT LIMITATION, LOST PROFITS, BUSINESS INTERRUPTION, DAMAGE TO EQUIPMENT, COMPUTER PROGRAMS, OR INFORMATION SYSTEM, OR THE LOSS OF ANY INFORMATION OR DATA. THE MAXIMUM LIABILITY COLLECTIVELY OF THE COMPANY SHALL NOT EXCEED TEN DOLLARS ($10) FOR ANY DAMAGES OF ANY NATURE, INCLUDING GROSS NEGLIGENCE, ARISING IN CONTRACT, TORT OR OTHERWISE.
Entire Agreement. These terms and conditions and the Privacy Statement constitute the entire agreement between Company and You with respect to Your use of the Forward Rewards program. Any cause of action You may have with respect to Your use of the Forward Rewards program must be commenced within one (1) year after the claim or cause of action arises. If for any reason a court of competent jurisdiction finds any provision of the Agreement, or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of the Agreement, and the remainder of this Agreement shall continue in full force and effect.
Privacy Statement
Forward Corporation is committed to providing our Customers with the highest level of customer care by continuously improving our services, quality products and image. The information gathered by our Forward Rewards program will be used in furtherance of that mission. We will not release your name to any list service or manufacturer, and this information will be held in the strictest of confidence.
